It is important to monitor the notice submission deadlines to avoid losing the right to arbitration. If the notice is submitted after the expiration date, arbitrators may refuse to consider the dispute.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Costs_of_FOSFA_Arbitration\"><\/span>Costs of FOSFA Arbitration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Typical total budget for a first-tier FOSFA arbitration under the 2026 Rules sits in the <strong>\u00a320,000\u2013\u00a330,000<\/strong> range (deposit, Federation fees, arbitrators&#8217; fees and party-side preparation). The claimant pays an initial deposit of <strong>\u00a310,000<\/strong> within 30 days of lodging submissions (Rule 1(f)); the tribunal may call further deposits during the reference. The appeal deposit is <strong>\u00a315,000<\/strong>. However, FOSFA arbitrators may refuse to reimburse costs if the case does not require legal involvement. Parties can apply for interim measures, such as a <a href=\"https:\/\/danil-hristich.com\/en\/worldwide-freezing-order-freezing-debtor-s-assets-around-the-world\/\" target=\"_blank\" rel=\"noreferrer noopener\">Worldwide Freezing Order<\/a>. This can be useful in cases where there is a risk of the respondent&#8217;s assets disappearing before the arbitration decision is made.<\/p>\n\n\n\n<p>Interim measures can include the arrest of bank accounts, real estate, and other assets of the respondent. These measures help ensure the enforcement of the arbitration decision and protect the claimant&#8217;s interests. However, securing interim measures can be complex and require additional litigation, especially in international disputes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Appeals\"><\/span>Appeals<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>FOSFA decisions can be appealed to the FOSFA Appeal Board. Any party can file a notice of appeal no later than 28 days from the date of publication of the first-instance decision, with the appellant paying a deposit of \u00a320,000.<\/p>\n\n\n\n<p>The appeal process involves a full review of the case, and parties can present new evidence and arguments.
