I have written about the standard Rules 125 <a href=\"https:\/\/danil-hristich.com\/en\/gafta-arbitration-general-guide\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p>Gafta created Expedited Arbitration Procedure Rules 126 for rapid dispute resolution. The Association designed these rules for simple disputes of small value.<\/p>\n\n\n\n<p>The main advantages of the Rules are speed and cost. <a href=\"https:\/\/www.gafta.com\/write\/MediaUploads\/Arbitration\/GaftaArbitratorDirectory2025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Statistically<\/a>, arbitration under Rules 126 takes 4 months, and arbitration under Rules 125 takes 8 months. The average cost under the expedited rules is \u00a38,751,00. Under the standard rules, it is \u00a316,036.00.<\/p>\n\n\n\n<p>The dispute procedure is similar to the standard rules: the parties exchange documents, and then the arbitrator decides. For example, under Rules 125, the dispute can also be heard by a <a href=\"https:\/\/danil-hristich.com\/en\/gafta-tribunal-or-sole-arbitrator\/\" target=\"_blank\" rel=\"noreferrer noopener\">sole arbitrator<\/a>, and the time limits for filing under both rules can be extended.<\/p>\n\n\n\n<p>When considering a dispute, the arbitrator may inform Gafta that the dispute is too complex for Rules 126. In such a case, the Association may increase the arbitration fees.<\/p>\n\n\n\n<p>To summarise, Rules 126 are suitable for the following cases<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the amount in dispute is below US$200,000<\/li>\n\n\n\n<li>Simple dispute (buyer has not paid for the goods delivered).<\/li>\n<\/ul>\n\n\n\n<p>All Gafta pro-forma contracts refer to Rules 125. So if the parties want to apply the expedited rules, this should be explicitly stated in the contract. The problem is that it is difficult (if not impossible) to assess at the time of the contract whether the dispute will be for a small amount and whether it will be straightforward. Of course, the parties can always change the arbitration clause, but it is unlikely that the other party will cooperate once a dispute has arisen.<\/p>\n\n\n\n<p>For these reasons, Rules 126 are used less frequently.
