International arbitration has become a trusted method of resolving cross-border commercial disputes, widely relied upon by businesses across the globe.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Definition_of_International_Arbitration\"><\/span>Definition of International Arbitration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>International arbitration is an alternative (non-judicial) method of dispute resolution between parties from different countries, whereby an independent third party or a tribunal considers the dispute and renders a decision that is binding on the parties. It is one of the most common means of resolving international commercial disputes, governed by national laws and international conventions.<\/p>\n\n\n\n<p>What is an arbitral tribunal in the context of international arbitration? An arbitral tribunal is a collegial body constituted for the resolution of a specific dispute, operating on the basis of powers conferred by the parties. Such tribunals may be formed under the auspices of permanent arbitral institutions or established on an ad hoc basis. Although they are not part of any national court system, their awards are recognised and enforced by state authorities pursuant to international conventions.<\/p>\n\n\n\n<p>International commercial arbitration is frequently discussed in the context of foreign trade, as this is where the majority of cross-border disputes tend to arise. It is a specialised form of arbitration that addresses disputes arising out of international commercial transactions.<\/p>\n\n\n\n<p>It is important to understand that international arbitration is not a state court and does not form part of any national judicial system.
